Welcome to CarFixAI. These Terms and Conditions ("Terms") govern your use of the CarFixAI mobile application and website (collectively, the "Service"). By using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using CarFixAI, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any modifications.

2. Service Description

CarFixAI provides AI-powered vehicle diagnostic information, repair guides, and related content. The Service is designed to help users understand potential vehicle issues and make informed decisions about repairs. The Service includes:

  • Photo-based problem diagnosis
  • OBD-II diagnostic code lookup and explanation
  • Repair guides and instructions
  • Cost estimates for repairs
  • Vehicle maintenance tracking

3. Account Registration

To access certain features, you must create an account. You agree to:

  • Notify us immediately of any unauthorized access

4. Subscription Terms

4.1 Free Tier

The free tier includes limited access to diagnosis features. Free tier limitations may change at any time.

4.2 Paid Subscriptions

Paid subscriptions provide access to additional features as described at the time of purchase. Subscriptions are billed in advance on a recurring basis (weekly or monthly) through Apple's App Store.

4.3 Free Trials

Free trials may be offered for paid subscriptions. Unless cancelled before the trial period ends, your subscription will automatically convert to a paid subscription and your payment method will be charged.

4.4 Cancellation

You may cancel your subscription at any time through your Apple App Store account settings. Cancellation will take effect at the end of the current billing period. No refunds will be provided for partial billing periods.

5. Refund Policy

All purchases are processed through Apple's App Store and are subject to Apple's refund policies. We offer a satisfaction guarantee: if CarFixAI does not help you save money on your first repair, contact us within 30 days for a refund request, which we will submit to Apple on your behalf.

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Share your account with others or create multiple accounts
  • Attempt to reverse engineer, decompile, or hack the Service
  • Scrape or collect data from the Service without permission
  • Upload malicious content or attempt to harm the Service
  • Resell or redistribute Service content without authorization

7. Important Disclaimers

7.1 Not a Substitute for Professional Inspection

CARFIXAI IS NOT A SUBSTITUTE FOR PROFESSIONAL VEHICLE INSPECTION. The diagnostic information provided is for informational purposes only. Always consult a qualified mechanic for:

  • Safety-critical systems (brakes, steering, airbags)
  • Complex repairs requiring specialized equipment
  • Situations where you are unsure about the diagnosis
  • Any repair you are not comfortable performing yourself

7.2 Safety Disclaimer

Vehicle repair can be dangerous. By using our repair guides, you acknowledge that:

  • You assume all risk when performing vehicle repairs
  • You should use appropriate safety equipment
  • You should work in a safe, well-ventilated area
  • Some repairs require professional training and equipment

7.3 Accuracy Disclaimer

While we strive for accuracy, AI-based diagnosis has limitations. Diagnoses are based on the information provided and may not account for all factors. Cost estimates are approximations and actual costs may vary. We do not guarantee the accuracy of any diagnosis, repair guide, or cost estimate.

8. Intellectual Property

All content, features, and functionality of the Service are owned by CarFixAI and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our written permission.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARFIXAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO VEHICLE DAMAGE, PERSONAL INJURY, LOSS OF PROFITS, OR DATA LOSS, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless CarFixAI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of San Francisco County, California.

13. Dispute Resolution

Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through informal negotiation. If informal resolution is unsuccessful, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
